Citizenship Checkpoints Start to Spread Across The Constitution-Free Zone

As the immigration debate continues to rage in America, the application of the Constitution-Free Zone that extends 100 miles inland around the borders of the U.S. is spreading its application into what is blatantly being referred to as “citizenship checkpoints.”

This type of “fishing expedition” flies directly in the face of the 4th Amendment which guarantees that “The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath of affirmation, and particularly describing the place to be searched, and the persons or things to be seized.”

Nevertheless, Border Patrol appears to be implementing even greater latitude that it has been given to operate with little oversight. In just the last few days, I’ve reported on bus searches and detentions taking place coast to coast and north to south, creating a PR problem as well as a civil liberties crisis for companies like Greyhound Lines, Inc. that carries an estimated 18 million passengers per year. Public transportation is being treated by Border Patrol as some sort of loophole, as they perceive it to be a way for the undocumented to travel under the radar throughout the United States.

Well, they certainly aren’t limiting themselves to becoming ever-present on public transportation. A new report coming out of Maine covers a stretch of I-95 at 80 miles from the border that was brought to a halt for more than 10 hours as Border Patrol demanded that all drivers declare their citizenship status.  A second report from New Hampshire claims a three-day shutdown of normal traffic.

The New York Times reports:

Border Patrol agents closed off all southbound lanes of Interstate 95 north of Bangor, Me., stopping drivers, searching outside their cars with drug-sniffing dogs and refusing to let them pass until they disclosed their citizenship. At least one encounter was captured on cellphone video.

“Good afternoon, ma’am, U.S. Border Patrol immigration inspection,” an officer told two reporters with the Bangor Daily News who had heard about the checkpoint, about 80 miles from the Canadian border, and decided to drive to it and record their interaction. “What country are you a citizen of?”

The driver protested. “If you want to continue down the road, then yes, ma’am, we need to know what country you’re a citizen of,” the agent said.

This alone is an absolutely egregious constitutional violation of the assumption of innocence upon which the country was founded. The refusal to permit interstate travel without being subjected to a federal force is just an extra measure of tyranny layered on top.

If one needs more proof that these checkpoints are fishing expeditions, a Border agent states it quite clearly:

“It’s just a random checkpoint. It’s within 100 miles of the border,” the agent said. “We just occasionally set them up to see what we can catch.”

The agent added that the officers look for signs that include how people answer their questions and if they speak with an accent. He argued the stops were fair and free of potential bias because every person who passed through the checkpoint was asked the same question.

Last time I checked, many of my friends and acquaintances are perfectly legal citizens and long-term legal residents who speak with accents. It’s the melting pot that the U.S. is quite known for and, up until now apparently, has been widely respected for. The ACLU of Maine weighed in with similar sentiments of outrage.

Emma E. Bond, a staff attorney at the American Civil Liberties Union of Maine, said she found it troubling that the Border Patrol agent in the Maine video mentioned that officers take note of a person’s accent.

“The Fourth Amendment requires explicit, neutral limitations on the conduct of individual officers,” Ms. Bond said Friday. “Yet here, the Border Patrol officer in the video claimed that ‘it’s the agent’s determination’ whether to detain people and that suspicion could be based on ‘accent, could be anything.’”

It is slowly beginning to dawn on people that when you restrict the freedoms of certain groups, that arbitrary system of oppression eventually boomerangs back upon you. I cite world history as irrefutable evidence. For anyone still unfamiliar with what is faced by the majority of U.S. citizens, please review the situation below.

As you can see in the map and video, the Constitution-Free Zone includes every major city in the U.S., putting 2/3 of the population under de facto federal rule that severely compromises the rights most people believe they entitled to as legal citizens or residents of the United States.

As also noted above, the definition of “border patrol” no longer means dealing strictly with human agents. The deployment of drones, biometrics, DNA collection, electronics searches and even social media checks are spreading as well.

I have also included below an overview by the ACLU of why the expansion of the Constitution-Free Zone is a threat to everyone. I’ve also included a video of what freedom looks like in Syracuse, New York as travelers of all types are interrogated for their citizenship status.

Outdated Legal Authority and Lack of Oversight

  • The regulations establishing the 100-mile border zone were adopted by the U.S. Department of Justice in 1953—without any public comments or debate. At the time, there were fewer than 1,100 Border Patrol agents nationwide; today, there are over 21,000.
  • The Border Patrol often ignores this regulation and rejects any geographic limitation on agents’ authority. At least two federal circuit courts condone Border Patrol operations outside the 100-mile zone, federal regulations and Supreme Court precedent notwithstanding.
  • Federal border agents are stopping, interrogating, and searching Americans on an everyday basis with absolutely no suspicion of wrongdoing, and often in ways that our Constitution does not permit.
  • For example, Border Patrol, according to news reports, operates approximately 170 interior checkpoints throughout the country (the actual number in operation at any given time is not publicly known). The ACLU believes that these checkpoints amount to dragnet, suspicionless stops that cannot be reconciled with Fourth Amendment protections. The Supreme Court has upheld the use of immigration checkpoints, but only insofar as the stops consist only of a brief and limited inquiry into residence status. Checkpoints cannot be primarily used for drug-search or general law enforcement efforts. In practice, however, Border Patrol agents often do not limit themselves to brief immigration inquiries and regularly conduct criminal investigations and illegal searches at checkpoints. The Border Patrol also frequently pulls over motorists in “roving patrol” stops, often without any suspicion that an immigration violation has occurred.
  • The ACLU has documented numerous cases of abuse by Border Patrol and filed lawsuits to obtain more information about the agency’s practices. Given Border Patrol’s lack of transparency, and in the absence of any meaningful oversight, there is still much that we don’t know about the full extent and impact of these interior “border enforcement” operations.

    I understand “dumbing down”,

    Bertrand Russell,1953: “… Diet, injections, and injunctions will combine, from a very early age, to produce the sort of character and the sort of beliefs that the authorities consider desirable, and any serious criticism of the powers that be will become psychologically impossible…” (“The Impact of Science on Society”, Simon and Schuster, New York, 1953)

    But, hey all, their is NO “constitution free” zone. When some governmental agency or one of those who SERVE WITHIN our governments try to pretend that they have that power to create one, we need to immediately charge them with three or four felonies (breaking the supreme Law (US Constitution), breaking the highest Law of the state (state’s Constitution), breaking the Oaths to one or both of them. Plus at least 4 charges of Perjury.

    Remember, as with any “job”, one is required to follow and KEEP the contract or no longer meet the requirements of the position. They do get their day or more in court.

            I read it already. I’m not a genius by any stretch of the numbers that is applied and made up. All I said, is indigenous peoples may think of the article. If I take over your lands, a generation from now how would your offspring think of it compared to mine?

            Things are what they are and has been for many generations. Do we give the land back to the Indians or to France, England and Spain and let them return it to the Indians? Should Mexico return the country to Spain or the Natives? Yes what we did to Native Americans was beyond terrible but I didn’t do it. Should I pay for what started in 1492……….

          Yeah. Perspective. People whom do not have the time to assimilate will cause chaos to those whom are already there. No way I can assimilate to a big city, if I bring my entire region and try and force that city into the way we wish it be…problems, for both sides. Yes? Anything sudden from someones comfort zone, their daily live will be problematic. No government has a policy, that I can see, on acclimation. Just thrusting peoples together, creating chaos and making new legislation to ‘control’ it. I could be wrong.

  3. Kind of thing that happens when one part of the citizenship torments the smaller and, or, less represented portions of the populace.

    You end up with a nation that cannot accurately perceive it’s threats, and a citizenry that is always up in arms about something.

    Volatile way of life, the winners are so very few, and the wealthy always lose.

    People getting up in arms about all this ‘illegal immigration’ is hypocrisy is of itself. Where did you ancestors come from? And, wasn’t there people already here when said immigrants got here? Let me see…I believe they were..savages? Oh, yeah: conquered by the West! So that is a moot point. Plus, the S.W. was Mexico, and we took it by force. Same with CA. And much of the North as well. The East, Midwest. More antics.

  8. The invasion of illegals cannot be sustained. Unfortunately, there is no nice way to correct the situation. Come here legally, and become a citizen. Then, and only then, are you elligible for the rights and priveleges this country offers.

  10. The only checkpoints should be at the welfare offices. If those people would ask for a U.S. passport, illegal immigration would stop immediately.

  12. As an old analyst a couple of points: one, look at this issue like a cancer- ignore it and it spreads. Second, both the ACLU & NAACP were started by Socialist / Communist entities. ACLU to change our legal system, NAACP, to agitate the Blacks, NOT for the Blacks- one simple word of difference. Alger Hiss, laughlin Currie, and others in Roosevelts cabinet, convinced him and others to repatriate 250, 000 Communist fighters to Central & South America. Next Norman Thomas noted he no longer needed to run for President ( 1944 ) as the Democratic Party had taken over the Socialist / Communist platform. There is so much more hidden in the closet, but I digress. The results of the manipulation of our society continue.
