New York’s Constitution-Free Zone Leading to Warrantless Bus Searches and Detentions

An increasing number of people are becoming exposed to the fact that they reside within a “Constitution-Free Zone,” as it has been dubbed by the ACLU for many years. In fact, it is estimated that 200 million people (2/3 of the populace) are likely to have their 4th Amendment protections completely disregarded by border patrol, as well as to encounter other routine violations unbecoming to a land of the free.

Nearly all of New York state, for example, lies within a 100-mile region that extends inward from all borders of the nation as shown in the image below.

As the video above introduces, the definition of “border patrol” also no longer means dealing strictly with human agents. The deployment of drones, biometrics, DNA collection, electronics searches and even social media checks are spreading as well.

This reality appears to be dawning on more residents, as “daily citizenship checks” have begun to spread to buses across states like Maine, and now predominately upstate New York, according to a new report from Syracuse.com. Moreover, it appears that many of the people who are being caught in the fishing expedition are demonstrably either long-term residents and/or those who are in the process of becoming legal.

Miguel Robles was on his way to New York City from Cleveland in August last year when the bus he was riding stopped to pick up passengers in Rochester.

Border Patrol agents boarded the bus and asked the five Latino men on it for papers, Robles said through an interpreter. When they asked him for his paperwork, he showed them papers from his Green Card application, which is pending in immigration court in Cleveland, he said.

“They put me in handcuffs,” Robles said. He said agents told him his application to be a legal, permanent resident didn’t matter.

Robles, 36, is married to a U.S. citizen and has 11-year-old twin boys who are also U.S. citizens. He works in construction in Cleveland, he said. He entered the U.S. illegally from the Dominican Republic 12 years ago.

Robles was taken to the federal immigration detention center in Batavia. While there, he said, agents pressured him to sign a voluntary removal order. If Robles had signed, he would give up his right to argue his immigration case and be fast-tracked for deportation.

Robles wound up being in detention for a month even as his Green Card application is on file and pending. And, according to immigration attorneys who have been receiving calls from others who were questioned about their documents, the overwhelming majority were already U.S. citizens or international students in the country legally. This is the exact definition of a dragnet fishing expedition.

Anyone with a conscience should ask whether or not this is a just “deterrent” that government has been touting through at least the last couple administrations. One should also rightly wonder what would have happened to Miguel Robles in the story above if had he been on the bus that day with his 11-year-old children after the revelations about child separation and detention taking place.

Note: as this article was being written, it appears that President Trump has signed an Executive Order that will keep children from being separated from parents during detention. This deserves further examination, as the language is rather vague when it comes to the details of how exactly this will be ensured.

As the country continues to debate immigration, it would be wise to consider the increasing size of the web that is being built and whether we are willing to continue giving up the protections that should be enshrined to keep the innocent from being ensnared.


For additional information, I have included below and overview by the ACLU of why the expansion of the Constitution-Free Zone is a threat to everyone.

Outdated Legal Authority and Lack of Oversight

  • The regulations establishing the 100-mile border zone were adopted by the U.S. Department of Justice in 1953—without any public comments or debate. At the time, there were fewer than 1,100 Border Patrol agents nationwide; today, there are over 21,000.
  • The Border Patrol often ignores this regulation and rejects any geographic limitation on agents’ authority. At least two federal circuit courts condone Border Patrol operations outside the 100-mile zone, federal regulations and Supreme Court precedent notwithstanding.
  • Federal border agents are stopping, interrogating, and searching Americans on an everyday basis with absolutely no suspicion of wrongdoing, and often in ways that our Constitution does not permit.
  • For example, Border Patrol, according to news reports, operates approximately 170 interior checkpoints throughout the country (the actual number in operation at any given time is not publicly known). The ACLU believes that these checkpoints amount to dragnet, suspicionless stops that cannot be reconciled with Fourth Amendment protections. The Supreme Court has upheld the use of immigration checkpoints, but only insofar as the stops consist only of a brief and limited inquiry into residence status. Checkpoints cannot be primarily used for drug-search or general law enforcement efforts. In practice, however, Border Patrol agents often do not limit themselves to brief immigration inquiries and regularly conduct criminal investigations and illegal searches at checkpoints. The Border Patrol also frequently pulls over motorists in “roving patrol” stops, often without any suspicion that an immigration violation has occurred.
  • The ACLU has documented numerous cases of abuse by Border Patrol and filed lawsuits to obtain more information about the agency’s practices. Given Border Patrol’s lack of transparency, and in the absence of any meaningful oversight, there is still much that we don’t know about the full extent and impact of these interior “border enforcement” operations.

  1. Between the Patriot Act and NDAA, isn’t the entire US technically a Constitution free zone?

  2. Can’t help but wonder if this is part of a bigger, nefarious plan to get people thinking of themselves as citizens rather than nationals. Big difference. Nationals are those We the People born here who have rights enshrined in the Constitutions and are the sovereigns who create and give life to government. Citizens are a creation of government. These government creations have mere privileges that can be revoked, limited and otherwise subject you to fines, fees and licensing, certifications and “show me your papers” orders.

  3. In order to correct this mess, the people will have to learn that there are two “US govts”:

    1- The United States of America in Congress Assembled (govt of the people)
    2- THE UNITED STATES OF AMERICA, INC (corp of the bankers)

    The second are those who took over the nation after the fake 1934 Bankruptcy where FDR gave our gold, resource, and future human production to the bankers in exchange for little green pieces of paper that we could have printed ourselves.

    All the “laws” that oppress us are corporate policies that do not apply to human beings living on the land. But that’s another story for another day.

However…having said that…don’t come to The US illegally, and you wouldn’t have to worry. isn’t that what all the “rights takers” are always saying to us?

  7. Nearly all presidents of the US have been depraved despots, particularly in the last 125 years. Trump is no better than Bush, Clinton or Obama. Bush is America’s Caligula who makes Jeffrey Epstein look like a saint. Who is Jeffrey Epstein but a convicted pedophile billionaire with his own island “Orgy Island” with his own jet “Lolita Express” who has wined and dined many of the leaders of the US and around the world including media moguls.

    This is all part of international child trafficking that results in more than most want to know as Ted Gunderson showed quite openly and is global.   8. 100 mile Constitution free zone is good idea. This means that while illegal aliens are in it, they have no rights and can be shot.
