FL Man's 'Patriot Garden' Targeted Again - City Threatens Uprooting and Daily $500 Fines

Jason and Jennifer Helvenston were given a strict deadline of November 7 to uproot their beautiful 25x25 foot front yard garden - or else face major punishment. That garden still stands and so does their resolution to keep it.

A flood of supportive emails initially stopped the threats of forced excavation by Orlando, cancelling a December board hearing, but, as always when perceived public fervor ebbed, the city quietly came back to demand its removal again. Starting tomorrow they will be inspected and charged $500 per day if the garden isn't gone - they are not deterred.

Instead, they have launched "Plant a Seed, Change the Law" and want to help you get started. Of course, the news anchor gave the wrong website - go to Patriot-gardens.com to request free seeds and start your garden in solidarity. Please see more details below.

Ironically, Orlando is aspiring to be the "Greenest City in America" and their mission statement reads:
To inspire and facilitate the development of a well-planned, diverse, and sustainable community to make Orlando more livable for its citizens, businesses and visitors.
The mayor encouraged its citizens to grow gardens even appearing in an ad! Caricatures are depicted planting gardens everywhere in the city - growing with neighbors is encouraged. Look at all the things Mayor Buddy Dyer tells the townspeople to do:




But codes are codes, and this one vaguely demands that "ground covers be planted in a way that gives off a finished appearance so neighborhood lawns are clean, and inviting - keeping property values up." The violation, however, simply states failure to keep grounds covered.

There is talk of the city wanting them to invest hundreds in caging or boxed containers, or face the $500 daily fine - but wait! Wouldn't that further set them apart from the other "finished" lawns? Is that inviting and conducive to property values?

There is some buck passing and semantics with this issue. The mayor appears to support the Helvenstons, yet what else is he doing to repeal the violations which he admits don't exist because gardens aren't forbidden and the code doesn't address front yards? He sounds encouraging while talking about codes adapting to society's changing tastes and then mentions deploying a Green Works Task Force. Always beware of the words Task Force. Talk to the mayor below.

Jason isn't taking the bait - he and Jennifer said NO at every directive - if they had conceded at all, the Patriot Garden would be gone and with it, a growing revolution. The only way to stop the insanity is to keep going and ignore bureaucratic threats.

The greatest freedom you can give someone is the freedom to know they will not go hungry. Our Patriot Garden pays for all of its costs in healthy food and lifestyle while having the lowest possible carbon footprint. It supplies valuable food while being attractive. I really do not understand why there is even a discussion. They will take our house before they take our Patriot Garden.
His wife Jennifer said:

They say on their website:
All we want to do is use our property peacefully to grow our own food. The Constitution protects our property rights from arbitrary invasions like this. Help us tell our leaders “Hands off our food!” by planting your own Patriot Garden in your front yard. Here’s how.
Yesterday, Orlando officials told Local 6 that the case was on hold but revealed nothing else. Attorney for the Institute of Justice, Ari Bargil, said they were interested in looking at suing Orlando, but for the time being are "focused on helping the Helvenstons get the word out, encouraging the city to reach a sensible compromise here."

So far, there is no donation info to help the Helvenstons - it looks like they are the ones truly giving back.

You hear that Orlando? It just doesn't get any greener.

ActS Codes & Rules, are NOT LAWS. They NOT Lawful, many are not even legal. Communities need to band together to look at what is REAL LAW.

Having said that, we claim we are on earth to learn, look about you (& within)at ordinary people fighting & arguing about anything & nothing. Not much learning going on. So what wakes people up? Hardship, having something real to have reason to be upset, instead of the feeble things we get involved in.
The elite are doing us a favour even though they might not like to hear this. Now we really have something to focus on & think deeply about & plenty of Real SOMETHINGS to turn our ingenious computer minds to. and create solutions.
WE ALLOWED `WHAT IS' GROW we gave the elite the rope, now we need to see they hang themselves with it. Stand together,TALK but dont waste your time on anger.

I write to you all the way from Sydney, Australia. I read an article online regarding a garden belonging to City residents Jason and Jennifer Helvenston. Last year the City instructed the couple to remove their vegetable garden and replace it with something more consistent with the City’s view of how a garden should look and function. As a landscape architect I was very interested to follow the debate about what is and isn’t acceptable. I now read that the City will begin to fine the couple if they do not remove the garden. For a pro-sustainability City, and presumably one that supports people’s God-given right to grow food and feed themselves, I was very surprised to read this. Your reaction may be ‘this is our business and you are in Australia, not a resident of Orlando’. That is true. However, I also suspect that your City would not wish to be known internationally as being opposed to individual liberties, where they don’t harm other people, and against sustainable urban agriculture, which is taking hold all over the world. I respectfully request the City leave the couple to their own business. It is not the job of the City to interfere with people’s lives where there is no harm being done to others. And besides, they are actually doing something positive for the environment! They should be given a medal, not a fine. Thank you for reading my email and all the best.

Here in Switzerland, we have started to PLANT FREE GARDENS accessible to all - we don't want apples from New Zealand, honey from Mexico, tomates from Morroco...
Our children should / could eat apples, honey, tomato from their own school yards! Each one of us could/ should be served by FREE GARDENS along roads, "public parks"...because FREE FOOD = REAL FREEDOM, SOVEREIGNTY, ABUNDANCE TO ALL = real change = real FREEDOM = gift economy where life is JUST A GIFT .. and working out of PASSION may be possible!

It's very simple. When the so called "authorities" come to shut it down, they should be met by 1000 heavily armed militia citizens. Simply tell them to leave or face the consequences of a gun battle.

It time to stop playing around with tyrannical terrorists in government, be they local, state or federal. It's time to SLAP THEM DOWN HARD. At gunpoint if need be.

Everyone should plant veggies on every square inch of land. Let chickens run wild in backyards everywhere and make it impossible for them to handle such a volume of paper work and court costs. These people are out of control and need to be put in their place. They destroyed the agriculture in this country and we have to take it back even if it's one backyard at a time.

I love the look of a kept garden- be it flowers or food.
"Codes are Codes" they say.
I say laws are laws too, but it seems governments break and bend laws and we can't?
Leave the guy alone and move on to more important things like fixing crooked city halls.

We have a 16'x24'garden.It produced many quart jars of beans,peas,carrots,tomatoes and cucumbers. All organic. Also a lot of potatoes.We WILL have it again next year despite what the NWO crowd says!

WHAT’S WRONG WITH SUSTAINABLE DEVELOPMENT?
How could something that sounds so good be bad? Who wouldn’t want to be sustainable? Vibrant? Walkable? Bikeable? Green? These buzz words
were designed to make you think that you’re doing something good for the planet. This is the biggest public relations scam in the history of the world.

Sustainable Development was created and defined by the United Nations in 1987, and the action plan to implement it was signed onto in 1992 by US President Bush and 178 other nations. It was called Agenda 21, the Agenda for the 21st century. Considered unsustainable under this plan: middle class lifestyle, single family homes, private vehicles, meat-eating, air conditioning, appliances, dams, farming, you.

Clinton began to implement it in the US in 1993 by giving the American Planning Association a multi-million dollar grant to write a land use legislative blueprint for every municipality in the US. It is called Growing Smart Legislative Guidebook with Model Statutes for Planning and the Management of Change. This was completed in 2002 and is being used to train planners in very university, college and government planning office in the nation.

Growing Smart is Smart Growth. Growing Smart is in our planning department and its principles are in our city and county plan. Right now. Beside this, on the shelf, is The Local Agenda 21 Planning Guide put out by ICLEI and the United Nations. Urban areas are being consolidated and rural areas are being emptied of people through restrictive land use policies, gasoline costs, vehicle miles traveled taxes, loss of rural road maintenance, closure of rural schools, closure of rural post offices, water well monitoring, smart meters, and regionalization pressures. Smart Growth is not just the preferred building style for UN Agenda 21/Sustainable Development; it is the ideology.

Moving people into centralized urban areas in high density housing creates the perfect opportunity for domestic surveillance. This ideology is being used as the justification to radically change every city in the United States and to impose regulations dictated by unelected regional boards and commissions. It is remaking government. This dramatic revolution in private property rights extends to every facet of our lives: education, energy, food, housing, transportation. We are being told that this is OUR PLAN but it is not. We object to this manipulation and refuse to be subjected to it. Educate yourself. Speak out.

The gun nuts just go out and buy more guns, like when a fat chick goes shopping for skinny clothing. It is a reactionary non reality based move to get instant gratification and relief from stress.
The gun nuts have not stopped any of dozens of fascist crack downs implemented by BushBama, and the right to grow your own food will just be one more thing the American people accept. The gun nuts are busy shopping, they won't stop any of this.

Before you go after any citizen for any colorable code(s) you've dreamed up, I suggest you first honor your Oath of Office, then, prosecute all wrongful behavior that any of your elected and hired officials commit, then based on your zealous concern for compliance, demand that your wonderful President step down from office which he holds fraudulently; as his birth certificate has been proven a forgery and the Social Security number Obama uses was stolen from a man in Connecticut!

"BREAKING NEWS – Hawaii state registrar Alvin Onaka has publicly certified to AZ SOS Ken Bennett that Barack Obama’s Hawaii birth certificate is legally non-valid and the White House image is a forgery". But you think a couple that grows their own food in their front yard is somehow a crime? You are either a willing dupe or simply a traitor to our country.

You are so right and then some. I have tried in my own little way to get people to see what is going on and 99% turn a deaf ear. I am seriously thinking of starting a newsletter (paper) to reach the people without internet and are bored. Maybe while they are taking a dump they'll grab it for something to read and proceed to get some real educational shit. I gotta do something

someone asked why the front yard, not the back.... two reasons.... sunlight being #1, and enlightening neighbors being #2.

when i had my urban garden we lived on a triangle corner. the south facing side faced the lower income area of the neighborhood. Many kids who'd never eaten a fresh tomato, or planted a bean had the chance to do so, and loved every minute of it. Kids who mostly ate processed nuked junk food at home, savored the fresh blackberries, and nibbled on herbs they'd never heard of, like mint with stevia, sweet as sugar (sweeter actually) In many ways i feel i let them down when i moved, but i hope that since then others may follow suit. in the meantime, our farm works with various community gardening groups within the city, to provide expertise, seedlings, etc.
Also MANY US cities claim to be the future green- sustainable capital blah blah blah.... most of said cities are the most 2 faced when people pursue sustainable solutions on their own.
that is agenda 21, codex playing out.
be prepared to see more of this in the next few years, and be prepared to stand your ground, and plant like the future depended on it- because it does.

as an organic farmer, i know that we'd be out of business if everyone woke up and provided healthy food for themselves and their communities. a return of the midevil commons would put agriculture as we know it in the grave, i'd rather that then the alternative- healthy food being wiped off the face of the earth save for the elite. Urban agriculture is needed whether it's an individual, like this couple, or a community, like the garden destroyed in toronto. if we stand for this sort of corrupt code enforcement, we will roll over under any larger pressure, such as gun control tsa ndaa etc...
the resistance is fertile!!!! plant one seed, harvest thousands.
