Report: New York Confiscating Firearm Permits From Citizens Legally Prescribed Anti-Anxiety Medication

In the months since the Sandy Hook Mass Shooting we have seen the largest attack on private firearm ownership in the history of the country. From calls for confiscation to a push for numerous gun bans, the gun control lobby has done everything in their power to attack the 2nd Amendment.

Now, a report from a New York attorney has revealed that the New York State Police are instigating proceedings that are leading to the confiscation of pistol permits from citizens who have been legally prescribed anti-anxiety medicine.

Jim Tresmond, an attorney at Tresmond Law Firm, is currently representing two different clients who had their pistol permits revoked because of a prescription to an anti-anxiety medicine.

"We are representing a client right now who is impacted by this onerous activity of the government," Tresmond said in a post on WBEN.com.

"We were flummoxed by this whole matter," explained Tresmond. "The HIPAA act is supposed to prevent this kind of thing from happening. It's a gross invasion of our privacy rights."


According to Tresmond, the New York State Police are responsible for this direct attack on the 2nd Amendment due to the fact that they send the information to the courts that initiates the proceedings. Tresmond also noted that he believes the two clients he is representing are only the beginning to what could be a massive revocation of gun permits, all completely outside of law.

As noted by Paul Joseph Watson, this is most likely connected to the NY Safe Act of 2013 which has a provision that many mental health experts have spoken out against due to the fact that it could lead people who need help to stay away over fears of losing their firearms.
Section 9.46 of the NY SAFE Act of 2013 authorizes therapists, doctors, nurses and social workers to report patients they determine may engage in conduct that may result in harm to self or others. 
If a determination is made that the person in question poses a threat, the provision permits the government to confiscate firearms. The provision is a direct violation of the Fourth Amendment and the legal standard of probable cause. 
Sadly, attacks on gun ownership through the health industry are seemingly gaining ground with the number of reports showing health professionals helping police take away citizens' guns rising sharply since the Sandy Hook Mass Shooting.

Last week, a report by this author documented the horrors one American veteran faced after he attempted to visit a pain management doctor.

David A. Schmecker, a Navy veteran with no history of arrests or mental illness, had his guns confiscated during an illegal search of his home after he refused a forced psychological evaluation that was issued simply for seeking a follow-up pain management appointment.
Not having any past history of arrests or mental illness, Schmecker politely refused the evaluation, which was the beginning of what would end up being an illegal seizure of a patriotic veteran's guns during a search that was conducted without a warrant and without any regard for the law.  
After Schmecker refused the evaluation, his doctor called his house and heard what he claimed was an "odd" answering machine message that apparently led the doctor to call the police and order a wellness check. 
“The police came to my home, and, without any justification whatsoever, hauled me away for a psychiatric evaluation at a local hospital. I submitted to their forceful insistence under duress and fear of arrest or worse," Schmecker told Survive and Thrive TV.  
"So they came into my house and they searched my house, looking for contraband of anything, they looked through everything ... I basically knew if I resisted I would never have gotten out of the hospital, I would have gone into the hospital and possibly the morgue, and not only that, if I had survived, I would have been stuck in the hospital."
Clearly the powers that be, frustrated that their gun grabbing efforts have so far failed in Congress, are turning their sights towards mental health and the use of different types of doctors and health professionals to supersede the 2nd Amendment and begin backdoor confiscation of firearms throughout the country.

It's a good idea! People on mind-altering prescriptions and gun ownership just aren't a safe match.

Not just Aurora shooter, James Holmes, but it seems a majority of mass shooting murderers were on prescription antidepressant drugs. Many of these drugs cause personality changes and promote violent actions in the users.

This is just the beginning. I'm a Vietnam vet and am involved with medical records as a vendor. HIPAA is supposed to protect patient privacy. Nothing could be further from the truth. With EMR(electronic medical record) and Obamacare the feds will have instant access to your medical history. I signed up a couple yrs ago for VA benefits. I was quizzed about ptsd. Told them zip. Doc gladly would have given me free meds. I'll pass. My tip is to not tell your doc anything you don't want the world to know.

THERE is a condition in psy journals that drscribe people who like to get beat upon day after day. And thete are 5 termsI know of for those who are so morbidthey should be put on happy happy pills and yes have every damn blunt orsharp instruments put out of their reaches.

I slightly agree with the first comment. Psych drugs can cause major problems especially if combined with alcohol. Although there needs to be a little more to go on. And although hippa is supposed to protect patient privacy, I work in health care and it's used to justify firing staff that the administration doesn't see eye to eye with. If I'm at the hospital and I want to see what's in the ER before I go home so I at least know if I have to come back I can be fired for that under hippa. Staff can't even look up their own test results or medical records. In one instance a nurse was fired for looking at the results of a test on their 6 year old child.

Recent studies have shown antidepressants to be no more effective than placebos in treating mild to moderate depression yet doctors continue to hand them out like candy for any possible reason, all the while knowing their potential side effects. They lump together clinical depression with normal, temporary sadness or grief such as with the passing of a loved one and dispense unnecessary drugs far too often. Perhaps, we should focus more on wanton prescriptions than gun ownership as a psychotic can use many other tools besides guns to harm others.

What an over-generalization! That's like saying that because some priests are pedophiles it is never a good idea for priests to be allowed around children.

As someone else pointed out, "mind altering" drugs are handed out like candy and only a very tiny fraction of those taking psychiatric meds have any symptoms of aggression and psychosis. What about the multitudes of non-psychiatric prescription drugs that have mind altering side effects? Some people who drink too much alcohol become highly belligerent. Should we ban gun ownership for everyone who drinks alcohol and anyone taking any kind of prescription medicine? Just to be safe, of course.

Yes, it is common sense that we should prohibit violent criminals and many seriously mentally ill people from owning guns. That doesn't mean we should allow ourselves to fall into the Establishment's trap and down the slippery slope towards totalitarianism.

According the Dudley Brown, executive director of Rocky Mountain Gun Owners in Colorado, "gun-grabber Beth McCann has announced she is drafting a bill that will require the release of mental health records into a mass government-controlled database."

The Establishment and their "useful idiots" are piling on.

Knowing the lack of due process many veterans are being the subject to as they are increasingly whisked away at gunpoint for "psychiatric evaluations" (despite lack of evidence of any mental instability), none of us should be sitting on our hands waiting for this to blow over. It won't. TPTB get ever more emboldened with each right they take away.

After reading all of the comments above me, I have concluded this. Being heavily medicated (that's what anti-depresants do- even though you don't really "feel" medicated) and guns don't mix DEPENDING on what their purpose is. If you are going to protect your family from a burglar or rapist, then I don't care if your a Heroin addict, you deserve LIFE and not a horrible death from some criminal. You always have to opportunity to clean up. If you choose to keep using, eventually you will get caught and you will be in so much trouble, the last thing you'll worry about is guns. Secondly, registering guns, sadly is just that REGISTERING your only form of protection should fatal danger visit your home. Depending on where you live, your guns WILL be taken. Use common sense on this, Every person is an individual and SANE people have committed atrocities so evil, even Satan is scared of them. But, we must remember, guns ARE dangerous and will kill in the wrong hands. Guns can also be a God-send if attacked by those willing to attack you. The Second Amendment was written in our Constitution as part of the founding principles of the Untied States. This is a very important issue.

It's the abuse or misuse of these drugs especially in cocktails, with alcohol or for days without sleep that leads to memory loss or lapses in defining reality, almost like dreaming when you're awake but not aware.

This condition is not conducive to improving your motor skills, it does not help you to focus nor improve your aim. If a person in this state is in fight mode, his biggest fight is keeping his balance, the person is not very capable of identifying targets, never mind hitting multiple targets with bullets, one after the other.

This gives credence to the "theory" that Lee, Harvey and Oswald were unaffected by mind manipulation and got off a lucky shot that killed the sheriff, no that was Bob and Molly, whose father was to testify that every agent was a nice guy.

It's the mental abuse and terror tactics employed on 'the victim' while 'the victim' is drugged inches from death that induces the 'the victim' or to put it in perspective the 'prime or primed victim' to be in such a dazed state of mind, making it a given that most if not all fatal shots were fired by A. N. Other and friends.

These drugs and the covert 'conspiracy' actions of unsavoury agents should be banned. They are the root of the problem.

This is my opinion based on reading between the lines which would be impossible without the alternative media as monopolist media no longer reports the news, but rather files a prepared statement, that was sometimes written prior to the event.

The smartest thing you can do is not participate in our modern age of usury. Don't buy their medicines, don't rely on their government doles (all types including, pensions, medical and financial aids)don't eat their corporate foods, don't use their propagandized entertainments. You might find you will do quit well and live life large.

Amazing how many little minds there are out there!

The 60 year old guy who has a blood pressure reading of 160/110 goes on heart medication and dies the next month from a heart attack. Was it the medication or was he ready to have a heart attack?

People who go on anti-depressants are depressed! They were ready to do something crazy, THAT'S WHY THEY WENT TO THE DOCTOR TO GET MEDS IN THE FIRST PLACE! Did the study find that most mass killers were in anti-depressants, or did it find that most mass killers were suffering mental problems. Millions of people are on these drugs without running out and killing people. Disclaimer: I believe you're better off working through your problems in a chemical free way. Go for a walk. Do some nature runs. Get a girl friend or a friend.

For you idiots that want to use medication by seratonen increasing drugs let me hip you to something: these drugs are being forced onto us because of the way we answer a questionnaire. If you are sad and mopy you'll most likely be prescribed these. They don't tell you that you may suffer debilitating migraines when you try to ween yourself off. The FDA ok'd these drugs for use on us but I don't see anyone blaming them. Does it make sense that a doctor can prescribe a medication that could void your right to free speech, or religion, or any other enumerated rights (and non-enumerated which are supposed to be yours too). I'm so sick of people acting like they understand such complex but inevitable acts to the point where they want to make blanket assumptions. Ok. Here, s another then: most if not all of the mass shooters in the USA going back 20 years or more were democrats. Think about that!

I wish this had happened to me! Because if so, not only could I sue and personally make a mint, it would create a precedent that would stop this happening to others in the future.

So many idiots on here. Anxiety and aggression don't go hand in hand, anti-anxiety medication is not the same as an anti-depressant, a diagnosis of a non-violent mental illness or mood disorder should not bar you from being able to own a firearm...

Last time I checked the right to bear arms was not just for people without a mental health disorder. And last time I checked a majority of the anti-depressants and anti-anxiety medications were an effective way of treating depression and anxiety.

From the beginning, psychiatry has been used by the state to control nuisance populations. The Soviets dealt with political dissidents by putting them away in psychiatric institutions. Once someone is labelled, they are effectively silenced. Its all about CONTROL by the state, and always has been. Check it out...read a few books and you will find the truth about the history of psychiatry.
