Final FDA Raid and Takeover of Morningland Raw Milk and Cheese Dairy

Heather Callaghan
Activist Post

January 25th, 2013 was a sad day that marked an end to the two-and-a-half-year battle for Morningland Dairy raw cheese farm. Supporters watched as state agents finally dispensed of $250,000 worth of their cheese, embargoed since the day of the initial government-sponsored raid August 26th, 2010.

Watch the beginning of the final raid take place with a large waste dump truck ready to haul the cheese to a garbage site and remember the phrase, "I'm just doing my job." The families pull no punches letting the agents know of their wrongdoing. One of the agents laughs at the question "Do you enjoy destroying people's lives?"

How did we get here?

Joseph and Denise Dixon worked hard to take on Morningland Dairy in the Missouri Ozarks in 2008. The company has been around for more than 30 years and during that time - not one consumer went ill from their cheese - no one complained. Moreover, they brought jobs to the impoverished area, jobs that have been dissipated by the FDA and Missouri Milk Board.

While the Dixons were away in August 2010 when the Missouri Milk Board (MMB) called to say there was potential Listeria contamination - the California Department of Food and Agriculture had gotten the cheese from the Rawesome Food raid some 55 days earlier. Inspector Don Falls said they should be back up in a couple days but his attitude turned cold when he talked to the FDA. Then the FDA leaked a nationwide recall - of all the cheese - which to this day has never been tested. The original testing was from the Rawesome raid with very questionable testing methods, never verified and with no accountability.

Immediately, the cooler of some 35,000 pounds of cheese ($250,000 worth) was embargoed - no one was to touch it - agents said it wasn't worth giving to their dogs. None of the cheese even had the same batch number as the Rawesome cheese - all that cheese was long gone with no complaints from the consumers. Armed agents showed up and locked it all.

The agencies ordered it all dumped and destroyed, but the Dixons refused and fought to the end - for freedom - for the rest of us. They appealed and appealed but to no avail. Judge Dunlap had set impossible, absurd standards and clearly didn't understand milking cows. The costs of his "prescription" for doing business again cost hundreds of thousands not including their loss and trying to survive during the appeal. He ruled from the bench.

The FDA and Milk Board would not and will never allow them to resume - how is this able to happen? Big food companies like the one with the contaminated turkey that killed a lot of people resumed business as usual. Obviously, this isn't a contamination or public safety issue.

One author described it as a "Death by Bureaucracy" saying:
Very few people realize the FDA has an armed and very military aspect. They showed up at Morningland in camouflage and made a lovely impression on those able to be at the unveiling of the future of food safety 'FDA style.'
The last thing the FDA was concerned about was the truth. Don Falls lied in court as well. So we have liars, thieves, and destroyers abusing their deluded power and devastating the Dixon family, the families employed in the factory, the farms providing the milk, and all the families that relied on their goods for healthy immune systems. Company destroyed - out $250,000 - no compensation.

Joseph Dixon summarized the fight:
The state of Missouri has 6 million people from whom they draw tribute (taxes), from which they could fight us. To fight them, we had 65 cows. And the truth never seemed even to be a consideration, let alone a goal.
Pete Kennedy, president of Farm-to-Consumer Legal Defense Fund wrote:
The Morningland case was about FDA’s agenda to restrict access to raw dairy products with the eventual goal of banning them. The agency doesn’t hesitate in sacrificing a business like the Dixons’ in order to move its agenda along.

If Morningland were a huge corporate conglomerate, there would be no action taken against these people, but that's the problem, they're "PEOPLE" and Corp-Gov does not recognize the rights of people, only the wealthy elite and corporate titans-

The time has come, arm yourselves and refuse to comply with this Corp-Gov

Disgusting...Right now people are "taking" events like this in stride, but soon?

People will stand.

Hey "Hide Behind", what dark skinned people are you talking about. Sounds to me like you are a racist p***k. I have lived most of my life in countries with dark skinned people, with Arabic speaking people and with ex-communist people, and nowhere do they create BS like this. The whole purpose of the US government and its' little Nazi enforcers is to protect the profits of the corporations.
Please give any example of the this kind of action outside of US and EU.
Now you have earned your $20:00 as the little government troll that you are. Go back to watching your porn and masticating.

A prerequisite of being able to stand is to have a backbone; It takes a certain stiffening of the spine with the resolve to do so originating in the mind.
Most vertabrates need 4 legs to keep from crawling, man with only two crawls almost as well as if he had none but to give him credit he has learned to minmize his crawling by learning to bow; The middle stance, least likely to offend stance, the safest stance, and adopted it as his most comfortable stance.
Remember the days when family farms were falling like flies and mainly because they listened not to agriculturist who were of buisness and sound management but financial ones in our government..
Farm aid chsrity became the rage of liberals and failing armers alike.
Farms and farmers failed while pseudo cowboys and cowgirls wailed and when the farms hit the auction block the wailing ended and yells of bidding by all the farmers nearby who seen an opportunity to get a good buy off of their old neighbors misery was the cry.
There are darn few farmers corporate or not that do not exist without some form of subsidy and even the IRS has made them more comfortable than many another industry.
Price of milk is set by Dept of Ag corporate Dairymen and corporate marketing by Government chaired regional blocks.
As an example Kroeger sits on the committee that covers this mans block as does the largest corporate cheese maker.
Well at least this man seems to have faith that when he dies God will provide him with a new cheese factory.
Now if he does not spend too much time praying and stans upon his own feet maybe he will find away to snatch victory from defeat.
He sure as hell knows now that all the flag wavers and Haleiluja singers and his government. Are all just doing their job.

I called the missouri milk board - don falls 573-526-9756 and larry bassham 417-766-2500 and they don't think they did anything immoral? Let them know what you think.

interesting the FDA folks are armed with human life taking guns. This means that they are not only trained to kill, but they are fully prepared to kill in any given moment. Think about it, the agency that is "supposed" to protect people from things like Vioxx, thalidomide, meningitis carrying vaccines etc., has armed its people to KILL those who opposed its actions in any way. Given the gun toting individual is the person who executes their orders would suggest they are a coercive helping hand, not a cooperative helping hand.

When the "free" population cannot consume what it wishes, simply because what they wish to consume is "illegal," then the population is no more free then a ball and chained slave forced to buy all his supplies from the plantation store.

always have to throw in the "god" thingy. What if, just what if...there is no god? You people act like someone is taking care of you. It doesn't look like it to me!!!!

Maybe your god is expecting YOU to do something beside quote bible verses and praying for those that step on you.

And forget the Nazi thing! For gods sake, it just shows your ignorance and brainwashing. There was nothing wrong with the Nazis. I would love to argue this point, but I'll leave you a link to a video. After watching that video, you ask yourself if you believe Americans and Obama are much better than the Nazis.

I'm so disgusted with people who regurgitate what they've been told....and NOT what is the truth.

What about how Monsanto is adulterating and poisoning the food supply? Who's preventing the use of the poisonous nerve toxin Aspartame that inundates the American food supply?

If you buy the large producer's garbage foods, you support their illegal activities. If you don't buy...they can't profit. If they can't profit then, the game is over. The law is in YOUR hands. It's called, "Justice of the Wallet."

Drink coconut milk.
Cheese is not healthy to eat at anytime.

Don't fight in court, its rigged against you.
Fight in the marketplace. Buy from the small guys not the juggernaut producers.

Every dollar you spend on bad food producers, supports the destruction of real food producers.

I feel the selling of raw Milk, Cheese and other products can be very dangerous to anyone that consumes such. I also feel that any roadside fruit or vegetable stands as well as any Farmers Markets need to be fully regulated by a Federal Inspector, and they should be heavily fined and shut down if they are not found to have passed such inspections. My God folks... you don't know if these items are made under strict health guidelines or anything. Selling raw products and farmers markets items is like playing Russian roulette with the public's lives. My family and myself only purchase items in large stores for safety sake.

Don't you know that milk board is a corporation, FDA is a corporation, USA is a corporation (check if you don't believe it). All so called 'GOVERNMENT DEPARTMENTS" are corporations, non-profit. Corporations cannot legislate. Don't you know that? Why did Dixon's attorney not know it?

Anonymous said...

RWB, you just keep eating the food that you buy from the big box stores that the Big Corporations and government says is good for you then when you get diabetes cancer autoimmiune disease go get drugs from Big Pharm so the side effects cause you more harm then good and dont cry why me. It is truly sad that a farmer that isnt involved with big business can not grow or produce what he wants but big Ag can put poisons in and on our food and thats ok. As far as the selling and purchasing of raw milk products it is or at least should be my right to consume what ever product that I choose to.I should not and do not want government telling me what I can or can not eat or put into my body. As for the comments on here about God you can choose not to believe that is your right but those of us that choose to believe do not mock us. Because there will come a day when in the last moments of life that you will call out His name trust me you will no matter what you believe now. For the people that did not take a stand and hid behind its my job I hope you can sleep at night. I hope you realize that even though you do not farm if the government decides that what you are doinbg is something that they do not want you to do this could be you someday and you could be in the same position as the people here. And for the poster that said use your dollars to fight back, yes people use your dollars that is the only thing that government and big business understand, but also take a stand tell everyone who will listen and even those who will not about the injustices that are happening. Dont say I am just one person because that one person can change the world. Dont wait for someone else to do it cause that will never happen.

RWB: I do wish people like yourselves would educate yourselves. I've been drinking raw milk for 3 years, I buy it from a local farmer with a cow share. He keeps it scrupulously clean - if that's done then there's no risk of infection or bacteria. It's FAR healthier than pasteurized milk, which has had much of the beneficial bacteria killed. Pasteurization isn't necessary. PEOPLE DRANK UNPASTEURIZED MILK FOR MILLENIA and as long as the facilities were kept clean, no one got sick. You are far more likely to get sick from supermarket food, which is irradiated, soaked in pesticides while growing, and grown in lifeless soil that has no nutrients. YOu're eating food with no nutrients, but that has been radiated and poisoned; that's what all supermarkets do to all fruits and vegetables. Good heavens man, go do some research, you are being lied to.

It breaks my heart to see these farmers who have worked so hard to help people loose to Nazi corporation and shame on the people who work for these corporations. They all sold there soul to the evil side. All I, the little guy can say there are many who feel like me out there who feel for you folks and your families,God Bless you for just keeping a cool head.I don't know if I could have done that.

Folks I grew up on a dairy farm here in NE PA. My dad owned around 300 acres and he milked around 70 Holsteins. He also had a couple Jerseys because Dad said they gave slightly more richer milk. etc. We always butchered our own hogs, killed are own chickens, etc. I like my Dad, drank milk right from the bulk tank many times. We both always enjoyed the top layer where after the paddles were stopped for awhile, it was so much richer and better tasting. I used to hold a small roadside stand out in front of the family farm house many times, where I sold everything from garden grown vegetables to glasses of lemonade, to baggies of popcorn to folks that passed by. But, neither myself or Dad, once ever talked about the stuff not being healthy. We did not worry about it, we figured since we made and ate the same foods ourselves that it was fine. We were both sadly, very ignorant of the health and safety of others. I feel the Government is just doing their duties out of their job descriptions, and for the health and safety of us all.

Well RWB I can see your just another one of those suck ass government leeches!!! The milk you and your dad drank must not have been to bad for you, you lived didn't you! I'll bet it was better then what you can buy now!! Probably didn't have all of the hormones etc. in it! You better get your head out of the sand, the government is into everyone's business. The FDA in 2009 gave BioStratum the rights to Pyridoxamine a form of vitamin B-6, so now you can't get it, because they can't make a drug version.
On December 31st, 2011, President Barack Obama signed the National Defense Authorization Act for Fiscal Year 2012, containing provisions which authorized the indefinite detention, extraordinary rendition (and assassination) of anyone around the world without charge or trial. This law marked one of the darkest eras in American history, declaring the United States a battlefield and legally subject to the laws of war. Still think the government cares about you and the list goes on and on!!!!
It's al about CONTROL!!

RWB said...

The darkest era of American history as you call it 'Anonymous' above, was not when President Barack Obama signed the National Defense Authorization Act for Fiscal Year 2012... the darkest era was when 911 was allowed to happen because we were caught with our pants down, because we did not have such provisions in place as the National Defense Authorization Act.

Hey RWB,
"... when 911 was allowed to happen because we were caught with our pants down, because we did not have such provisions in place as the National Defense Authorization Act."
No, you were caught with your pants down because you trusted the government. They are not there for you, they are there for the military - industrial - complex, and their pensions.
Nothing in the NDAA would have prevented the planting of multiple explosives in the WTC buildings. When you understand why FEMA was in place the night before, why WTC 7 was "Pulled" by the Owner, why the Saudi royal family was evacuated by your government, then you will understand why they will not allow "raw milk"
You may want the government to protect you, I want protection from the government. This used to be provided by the Constitution and the courts, even though according to Bush, it was just a goddamned piece of paper. Now, as far as government is concerned, the Constitution should be provided in two-ply and perforated for ease of use.
The government is not the solution, it is the problem.
"All governments are conspiracies -- the means by which the rich exploit the poor." -- St. Thomas More
"The natural progress of things is for liberty to yield and government to gain ground." -- Thomas Jefferson
Even the Chinese can be wise!
"All political power comes from the barrel of a gun."
"The communist party must command all the guns, that way, no guns can ever be used to command the party" – Mao Tse Tung

I would have sent those government goons straight to hell if I owned that farm. I would also have hidden that cheese, even given it away rather that letting them destroy it. Oh if the owners of that farm would have killed any of those goons and I was on a jury I would have voted NOT GUILTY! Ron Roy

i find it fascinating that farmers haven't reacted more strongly. One problem is this: we think that corporations are doing this to us. Wrong.

Corporations are lumps of paper - a legally binding agreement specifying purpose of business, distribution of profits, listing assets, principles of organization, etc.

The rulings of the "corporate" puppets in the agencies and of those in the corporations themselves are ALL made by (sometimes, and too frequently) literally sociopathic people. These human people are the wealthy who are the corporate executives, management, and investors who control the direction that a company will go and what it will and will not allow in their practice.

This has NOTHING to do with the legal paperwork. That cannot react to changing market conditions, political/business environments, and other fluctuating conditions. These are ALL analyzed, and the options for dealing with them are made by PEOPLE! PEOPLE! NOT corporations.

These psycohpathic decisions are made by the self - appointed, self - annointed, so - called "elite".

So why haven't we had another drug induced group assault/violent act perpetrated upon the board of directors meeting, or the shareholders meeting of the GMO corporations and these other crazy murderers?

i am not advocating or condoning this sort of thing, but it seems more likely that only such a strong deterrent may stop these psychopaths from continuing on their path of genocide and social damage. By definition, a psychopath does not care about the damage they cause others IF they see some aspect that "improves" their personal life.

LOL, I love how the sky is falling on all of you. I must have missed something. Did the owner of the cheese have it tested to see if it was ok or did he just think he knew?
