Class Action Lawsuit Against Smartphones — Users Say They Weren’t Warned About Radiation Risks

Last month the Chicago Tribune published a report that 11 smartphone models (Apple and Samsung) exceeded the federal radiation safety limits.  This led to a law firm filing class action lawsuits on behalf of consumers.

SAN JOSE, Calif. (Legal Newsline) – A group of consumers filed a class action lawsuit against Apple and Samsung alleging that the cellphone manufacturers did not warn consumers of a risk of allegedly excessive radiofrequency radiation exposure in some of their devices.

Andrew Cohen and other plaintiffs filed a class action complaint on Aug. 23 in the U.S. District Court for the Northern District of California against Apple Inc. and Samsung Electronics America Inc., alleging negligent misrepresentation, breach of warranty, violation of the California Unfair Competition Law, violation of the California Consumers Legal Remedies Act and other counts.

The plaintiffs allege that they are users of the defendants’ products, specifically phones that they regularly carry near their bodies. The plaintiffs allege recent testing of the defendants’ iPhones and Galaxy phones shows that a user’s potential exposure to radiofrequency (RF) radiation exposure is over the recommended exposure limit if the phones are carried in a pants or shirt pocket.

The City of Berkeley, CA fought for many years for an ordinance so that simple written warnings were included with the sale of cell phones.  Of course, the Telecom Industry fought this every step of the way.  After all, if more Americans were aware of exposure risks, they might not buy these products for themselves and everyone they love.

Federal safety limits and testing for cell phones and all other wireless devices are over 20 years old.  They don’t apply to most current wireless radiation emitting products.  They don’t apply to the way most people use or are exposed to most current wireless radiation emitting products and infrastructure.  Obviously, this is something that needs to be addressed and corrected too.  Better late than never, right?
