San Francisco City Attorney Bans P2P Parking Apps, Threatens Users with Fines, Asks Apple to Remove from Global App Store

By Activist Post

The MonkeyParking app will have to delay their hopes of solving the parking problem in the greater San Francisco area because of a cease-and-desist order issued by the city.

MonkeyParking is one of several apps banned by the city that help drivers locate and reserve parking spots faster. The apps allow current occupants of a parking space to get paid to notify nearby drivers of their soon-to-be vacancy.

The city, clearly envious that they couldn’t figure out a way to profit from solving a problem on their own, declared the apps illegal.

San Francisco’s city attorney, Dennis Herrera, claims the apps are breaking the law because public parking spots can’t be leased without them getting all of the action.

Additionally, he said the ban is also because these apps “encourage drivers to use their mobile devices unsafely to engage in online bidding wars while driving.” Stop laughing. This isn’t satire.

Herrera threatened to fine anyone caught using the apps during this cease-and-desist period and even asked Apple to removed them from the iTunes app store – presumably to protect other metropolitan areas outside of his jurisdiction from such criminality.

We’ve seen incumbent cartels increasingly seek government’s protection against competition from voluntary apps like Uber and AirBnB. It’s getting quite easy to tell exactly who the government works for when they start banning voluntary apps that make people’s lives better.

  1. Sorry, just because something disrupts peoples lives, that does not mean it is a good thing. Banning this type of app is a good thing. Since when is it ok to auction off public assets?

I have lived in and around San Francisco all my life. It is where I was born. I know San Francisco. In San Francisco if an app like this is allowed to be in use, it will create a situation where people will make careers out of squatting on parking spots all day and only allowing somebody to park there if they are paid. The same goes for New York, Chicago, Los Angeles and any other dense urban area.

Good bye and good riddance, Monkey app.

    • If the urban planning of those “dense urban areas” by the “people’s servants” was not that horrible as it is, there won’t be a need for such apps and even for cars at all.

    • Right! People cannot assign rights to themselves. You cannot assign the right to deliver cab services just because you need money when there are municipal and state laws governing cab services.

People don’t get to make up whatever they want. That would be a corporate nightmare reality as companies would instantly monopolize everything for a profit.

      • Do you realise how ridiculous your last sentence is?
        They already have!

        • …and then face the consequences.

            This consequence?

“Whereas the bottom 50% of Americans owned only 2.5% of America’s total wealth at the economy’s peak in 2007, they owned only 1.1% of the total wealth in 2010.”

62% of the nation has no retirement savings beyond social security. 51% of the nation has no disposable income and earns less than $500 a week while half the nation’s average income is thirteen dollars an hour.

17 trillion dollars in capital was created to bail out international bondholders who were central banks whom then invested it all in the stock market and when their people reach the age of retirement those banks will be the single largest net-sellers of the U.S. stock market running the price down every single day.

          • That’s why all governments need to be abolished.

The belief in “authority”, which includes all belief in “government”, is irrational and selfcontradictory; it is contrary to civilization and morality, and constitutes the most dangerous, destructive superstition that has ever existed. Rather than being a force for order and justice, the belief in “authority” is the arch-enemy of humanity.

When corruptible but we have amazing tools to rout corruption that are not being used for it like the N.S.A. spying program.

We need to repurpose this tool for the good of the people.

          • This would be good but you know this will never happen 🙂

          • Government as it exists on the planet at present is corruption. If you want to get ridof corruption, you have to get of government. Give someone privelege, and only those who refuse it would be trustworthy with it.

          • I take exception with your reference to ‘civilization’. Civilization is nothing more than the use or threat of use of force to obtain compliance. The symbol of civilization is the bundled fasci around the central axe. The republic is just the latest window dressing on the ‘divine right to rule’ hoax started by those who originally declared themselves to be ‘offspring’ of the ‘gods’. One of the hallmarks of civilization is ownership of the land, which is ultimately claimed by government. The planet does not belong to us; we belong to the planet. Civilization is a seige on humanity.

  2. No government has the authority to pass any law which impairs the obligation of contracts.

    • Unless said contracts are illegal or inviolable.

        • Interesting, condemning all governments by illustrating government atrocities by dictatorships. While there are major flaws in our current US government, anarchy is not the solution. Somalia has anarchy.

Rules are necessary for society to function. We all inherently recognize the difference between right and wrong, but some individuals choose to do what is wrong, and hurt others. There needs to be some way to protect good people from evil people; this can only be done by force. Good people get together to establish rules for mutual protection, hence government.

We would have far fewer problems if the federal government remained constrained by the Constitution, i.e., only the powers enumerated. Over the past 90 years, the public, by their inattention to government or their greed for something for nothing, has allowed the situation to deteriorate to the point that the federal government is looked to first to provide the answer to any problem, instead of realizing that an overactive federal government IS the problem.

If something is important enoug for the federal government to do it, the Constitution should be amended to provide for it, rather than have it legistated by Congress, the President, or the Supreme Court.

The only way to change it is for each of us to get up from the couch and be more concerned about government than the Kardashians, and do something about it.

          • Despite the Constitution the situation is like it is and it won’t get better.
As Stephen Biko put it : “The most potent weapon in the hands of the oppressor is the mind of the oppressed.”
Wishful thinking will not change the situation.

By the way, your misconception about Anarchy is very common. But if you want to correct it : http://www.seesharppress.com/anarchismwhatis.html

          • They poisoned the well by changing the definition of anarchy in the
dictionary, which is a typical mind control tactic. I ask them to define
monarchy after they conflate anarchy with chaos. Here’s a site you
might want to refer to others regarding the constitution to the staunch
            defenders of the document:
            http://www.thetruthaboutthelaw

Very few people see the constitution for what it is. The supreme court
recently reaffirmed that the constitution was a contract between the
federal republic and the states, that the citizens are not party to. This
should nullify the 16th amendment (income tax), since their is no legal
basis for holding anyone bound to a contract that they are not party
            to.

          • I’m reading your site right now. It’s very good so far 🙂

          • ***Interesting, condemning all governments by illustrating government
atrocities by dictatorships. While there are major flaws in our current
US government, anarchy is not the solution. Somalia has anarchy.

The Viet Nam war was not waged by a dictatorship. Nor any other war the US has engaged in. You don’t understand what anarchy means. Soalia does not have anarchy. Anarchy: an = without. Archy = rulership. Anarchy means without rulership. Somalia is run by gangs. That is not anarchy.

***Rules are necessary for society to function. We all inherently
recognize the difference between right and wrong, but some individuals
choose to do what is wrong, and hurt others. There needs to be some way
to protect good people from evil people; this can only be done by
force. Good people get together to establish rules for mutual
            protection, hence government.

There is only one rule people need to follow: cause no harm. Force may be necessary in some cases, but establishing a monopoly on the use or threat of use of force is creating a gang mentality. A police force becomes a standing army and loots the populace by endless prohibitions.

***We would have far fewer problems if the federal government remained
constrained by the Constitution, i.e., only the powers enumerated. Over
the past 90 years, the public, by their inattention to government or
their greed for something for nothing, has allowed the situation to
deteriorate to the point that the federal government is looked to first
to provide the answer to any problem, instead of realizing that an
overactive federal government IS the problem.

The constitution was a sham. It prevented none of this, and was not intended to. It was intended to destroy states’ rights through centralization. Patrick Henry called it out in his anti federalist arguments before the start of it all, and he knew the people who wrote the constitution. The inclusion of the bill of rights was in the constitution was voted down unanimously, 10-0 during the constitutional convention. Only 39 of the 55 attendees signed the document. You’ve been programmed by the school system. It wasn’t 90 years ago that the problems started, they started with the constitutional convention: http://www.thetruthaboutthelaw.com/the-peoples-case-for-what-happened-at-the-constitutional-conventionon/
even after the states forced the bill of rights on the federal government before ratification, it didn’t take long for the politicians to start with the dirty tricks like the Jay Treaty of 1794 and the alien and sedition act. Jefferson warned about the dangers of political parties, but joined one right after he lost to John Adams. Trusting someone else to look out for your own interests is the problem.

***If something is important enoug for the federal government to do it, the
Constitution should be amended to provide for it, rather than have it
legistated by Congress, the President, or the Supreme Court.

If you don’t want something legislated by congress, the president, or the supreme court, then that leaves the federal government out of it entirely, so this comment makes no sense. The only alternative is for states to amend the constitution state by state, which bogs the whole process down.

***The only way to change it is for each of us to get up from the couch and
be more concerned about government than the Kardashians, and do
            something about it.

The only way to fix this is get rid of goverment and take care of your needs without interfering in the affairs of others.

    • Average Joe American | July 9, 2015 at 1:09 am |

And as you know, all governments do just that, Marty. They do it at gunpoint, and they point them (their weapons) into your childrens’ and grandchildren’s faces. They point weapons into your family’s guts and wide-eyed faces and tell you all how to be. How to behave. Leaving you one of two choices.

I’m a big fan of the movie “The Patriot.” I know the choices.

I’d like to think I’m not alone in this, but that’s of no consequence. We have to stand individually, or we will all fall together.

I will stand, whether I’m alone or not. I’ll stand. And just say no. (And, no, I won’t make it easy for them.)

    • No government has any authority at all. Authority is an illusion. The only legitimacy any government has is derived from the use or threat of use, of force, which they claim a monopoly on. the only legitimate function of government is the protection of individual rights, which is something no government prioritizes.

  3. Public parking spots. The public paid for the streets, the public pays for for repairs to same. The public paid for the “public” parking lots. Where do a bunch of self determined “elites” and political prostitutes get off charging the public to park in spaces that they paid for in the first place.

  4. I look at the big picture.

What is evident to me is the slow corruption seeping into every facet of our lives.
Just as Peter A Kirby suggests it will morph into people exploiting this for personal gain.
The attorney is fighting for his gain and the cities, and citizens will follow suit.

It all boils down to parasitic behavior.
We now adopt the same bad behavior of the criminals in office that we despise.

Evil never comes in large forms, it always starts very small, and if we fail to show the intelligence, fortitude and diligence to fight it at that front it grows like a cancer.

America is slowly dying from this.

The temptation of money and something to gain, (even when they KNOW it is to their own detriment) seems to be too much.

  5. How’s that so-called freedom workin’ out for ya DUHmerica? Hmmm?

  6. The city, clearly envious that they couldn’t figure out a way to profit
from solving a problem on their own, declared the apps illegal.

Not at all. The city does not want you to find a legal place to park, in the hopes you will be forced to try your luck parking in a ticketable spot. It’s all about the massive parking ticket scam, and the large percentage of those that miss paying the tickets on time, providing even more massive revenues through the brutality of the corrupt court system.

New York City cops briefly stopped issuing parking tickets in response to the mayor’s crude remarks about them, and the daily revenue loss to the city was in the MILLIONS!!!

    • Average Joe American | July 9, 2015 at 12:28 am |

I observed, working in NYC some years ago, that you could make a living selling parking spaces. Just buy an antique Mercury and cruise around lower Manhattan, find a parking space, and sell it for five bucks (people yell out their car windows if you so much as reach into your pocket while strolling down the sidewalk: “Are you moving your car?”). Do this all day long, the bucks would rack up, you could make a serious living. Beats driving cab. Of course, the downside is you have to live in New York City to do this for a living. Who could afford the overnight parking tickets? They make people re-park in their underwear at 7:00 AM on alternate Tuesdays and Thursdays and Saturdays, snow, rain, or shine (Mondays and Wednesdays depending on which street you parked on, but then it’s 6:00 AM or 8:00 AM, depending on which phase of the moon it is in…well, somewhere, just read the signs.) Greatest city on Planet Earth. Couldn’t wait to get out of it. Quit my job to get out of there. Found a parking space in San Diego. No signs.

  7. Making an app illegal? Is that a dangerous precedent or what? Notice how a whole new area of repression comes from San Francisco, the very picture of a “progressive”, “liberal” city. Not a coincidence.

  8. I do not consent to his arbitrary and capricious edict and neither do you have to give your consent! Tell him to pound sand! File a complaint with the BAR to have him disbarred for violation of his oath of office!

    • The BAR (British Accredited Registry) association? Whose side do you think they are on? The constitution was written by mostly bankers and lawyers.

      Warning: lawyer joke ahead:

God adressing the devil, who is creating a ruckus outside the pearly gates: “I demand you immediately cease and desist in these actions, or I will send my my solicitor (British term for a certain type of lawyer) after you!”

Devil: “Where the hell are you going to find a solicitor?”

  9. So, what do you think decent peopel?
Have you had enough of the liberal dem bloodsuckers, yet?
Obviouas to all of us, we can no longer coexist with the liberal scum.
Force partition, it is the only way to prevent civil war.

    • The democrats aren’t liberals. The republicans aren’t conservatives. You’ve been played. Forcing partition would be de facto civil war. See my comment above.

      • The separation must come, or there will be civil war, frankly there are a ,lot of people that wouldn’t mind at all.

        • Separation will only come through civil war or total systemic collapse. Without a collapse, separation IS civil war. If you don’t understand that, you don’t understand government. That is what the banksters want. The only answer is to stop cooperating with govzilla. The only true capital govzilla has is the cooperation of the populace. Govzilla needs us. We do not need them. Stop using their money to the greatest extent possible. They are going broke fast. When they can no longer keep the fraudulent stock markets afloat, the emperor’s new clothes will be visible to the majority.

  10. Don’t you just love government over reach when they don’t get their cut of the action??

  11. Well folks Welcome to Obama’s America where the government controls the people. And fines them if you dont comply. Conservatives had him pegged right all along!

    • You’ve got one closed. And Idoubt you know what a conservative is, let alone a liberal. A conservative tends to their own needs without interfering in the affairs of others, so they stay out of politics and don’t vote, because that is interfering in the affairs of others. A liberal is someone who does not believe in class distinctions, or equal rights for all. Liberals also stay out of politics and don’t vote, because that creates the class distinctions of rulers and subjects. Liberals and conservatives are not opposites or mutually exclusive. thebelief that they are opposites is just another ‘divide and conquer’ ploy to distract the unthinking mass. If you believe that everyone has equal rights, and you tend your own needs without interfering in the affairs of others, then you are both liberal and conservative. The media has just perverted the terms to confuse the voters.

  12. Since when does a city attorney have the authority to make law ??? Who does he think he is, Obama with a pen and phone ?!?!?!
