U.S. Health and Human Services Does NOT Trust Congress

“It’s an unacceptable violation of law and a dangerous precedent for any Administration to tell a private company not to respond to a lawful subpoena,” Issa spokesman Frederick Hill said in an email.

The above response came about because Chairman of the U.S. House of Representatives Oversight and Government Reform Committee, Darrell Issa, issued a subpoena to a government contractor regarding their turning over non-redacted copies of security-testing documents relating to websites for Medicare and Medicaid, which come under the U.S. HHS.

From the sublime to the ridiculous, that’s how to classify HHS’s blatant expression as to why it told a government contractor not to reply to a Congressional subpoena! If the folks at HHS don’t know that the U.S. Congress has oversight [U.S. Constitution] over federal agencies and their contractors, well as they used to say, “Step down!” meaning, you ought to – or be required to – hand in your employee badge(s), even at the highest levels.

That kind of chutzpah – sheer defiance – seems to be the predominant mode of self-styled operations for federal agencies anymore, especially within the current administration, or is that something this writer is not interpreting correctly? Rogue actions, like those taken by HHS, are what used to be called contempt of Congress. Or, is that what’s now become known as the ‘official federal middle finger’ norm?

Is it much more than that, though? As this writer interprets it, it is the deliberate rejection, non-compliance with, and substitution of the U.S. Constitution and the form of constitutional government that it established. Ultimately and probably, will such non-compliance lead to some form of new federalism, or even a socialist state declared by fiat? That’s what all these recent federal shenanigans seem to be leading up to: A piece-meal rejection, plus the introduction of a new form of governance since the U.S. Constitution and the Bill of Rights are deemed archaic and in need of revision.

Supposedly, Minority Leader Pelosi is credited with having made the statement, “President Obama knows more about the Constitution than any man who has ever lived.” How about telling that to the Founding Fathers! How about studying President Obama’s Presidential Executive Orders published in the Federal Register.

Moreover, blogger Carl Herman contends the following: “American fascism: by political definition the US is now fascist, not a constitutional republic.” He wrote that back in December 2009!

So, it seems that a partisan cat fight is going on within the U.S. Congress regarding how the United States will proceed to be governed.

As this writer interprets it, it apparently looks like this:

The U.S. Senate wants to lead the way to a new form of governance by fiat with a revised Constitution written by someone who apparently needs a refresher course in Constitutional law and how not to break it as president, and the House of Representatives members, who want to abide by the U.S. Constitution, the founding principle that freed the colonies from kingship bondage and has worked up until now, when an upstart Constitutional lawyer, whose scholastic records cannot be found and who ‘lost’ his license to practice law, wants to change it. That’s a scary divide. What do you think?
