3 More States Propose Bills to Resist Federal Gun Control

Activist Post

It has been the biggest week yet for states introducing bills across the board to nullify federal tyranny. The Tenth Amendment Center has highlighted progress toward halting drone use in American skies, eliminating the "indefinite detention" provision of the NDAA, promoting hemp freedom, and nullification of Obamacare. (Source)

Three states are also taking a stand against federal restrictions being proposed for gun ownership: Kentucky, Montana, and Alaska.

It has been exhaustively proven that tighter gun regulations do not result in a safer society, but in fact do help pave the way for democide. As pressure from the U.S. government to disarm the population intensifies, it is important to look at the legislation introduced by these three states as models for what can be implemented across the nation.

1. Kentucky approved bill SB 129 by a vote of 34-3, which seeks to render all federal rules and regulations as unenforceable. Significantly, it mentions gun registration:
Any federal law, rule, regulation, or order created on or after January 1, 2013, including any amendment or other change made after January 1, 2013, to a preexisting federal law, rule, regulation, or order, shall be unenforceable within the borders of Kentucky if the law, rule, regulation, order, amendment, or other change attempts to:
(a) Ban or restrict ownership of a semi-automatic firearm, magazine, or other firearm accessory; or

(b) Require any firearm, magazine, or other firearm accessory to be registered in any manner.

The one-page bill can be found in full HERE.

2. Montana introduced House Bill 302, which, as The Tenth Amendment Center states, doesn't even have "to rely on the goodness, courage, and constitutional understanding of their own local Sheriff – HB302 would make it state law that no state agent, agency or peace officer working in the state of Montana would be allowed to enforce such violations of the 2nd Amendment."

This statement is important, as it has been argued that even though hundreds of sheriffs have declared that they will not comply with federal demands, there is plenty to suggest that many already have compromised the rights of citizens in the past and very well could be willing to stand aside if federal pressure becomes too intense.

Montana's two-page bill seeks to address this possibility by prohibiting compliance, even with a ban on semi-automatic weapons and large capacity magazines. Additionally, it highlights that taxpayers shall rightly direct the course of action when expending public funds, deeming to criminalize their unauthorized use. Section 3 states in part:
(1) A peace officer, state employee, or employee of any political subdivision is prohibited from enforcing, assisting in the enforcement of, or otherwise cooperating in the enforcement of a federal ban on semiautomatic weapons or large magazines and is also prohibited from participating in any federal enforcement action implementing a federal ban on semiautomatic weapons or large magazines.
(2) An employee of the state or any political subdivision may not expend public funds or allocate public resources for the enforcement of a federal ban on semiautomatic weapons or large magazines. Any expenditure of public funds or public resources, including paying the salaries of personnel, to enforce or participate in the enforcement of a federal ban on semiautomatic weapons or large magazines is an unauthorized use of public resources and is considered theft as provided in 45-6-301.

Take Action in Montana:

Contact your State Senator. Make sure they know you want them to vote YES on HB302. If the federal government is going to try even more attacks on the 2nd amendment, Montana will not have ANY part of it. And, by doing so, Montana will help play an important part in the demise of such unconstitutional plans.

3. Alaska has passed House Bill 69, The Second Amendment Preservation Act, by a margin of 31-5. The bill focuses on the right of the state of Alaska to supersede any Congressional regulation that should seek to end-run the state through interstate commerce laws:
The authority of the United States Congress to regulate interstate commerce in basic materials does not include authority to regulate firearms, firearm accessories, and ammunition possessed in this state or made in this state from those materials. Firearm accessories that are imported into this state from another state and that are subject to federal regulation as being in interstate commerce do not subject a firearm to federal regulation under interstate commerce because they are attached to or used in conjunction with a firearm in this state.
The bill goes on to highlight that it is a class B misdemeanor punishable by a $2,000 fine and up to 90 days in jail under AS 12.55 for, "an official, agent, or employee of the federal government who enforces, attempts to enforce a federal statute, regulation, rule, or order that is unenforceable under this section."

Alaska representative Mike Chenault stated perfectly the sentiments of those who wish to preserve the bedrock of freedom, even as we acknowledge that tragedies using firearms will occur: "Tragedy is not a license for federal encroachment of constitutionally protected freedoms."

There is a simple reason why tragedy can never be permitted to re-write essential freedom: the possibility that tragedies can be manufactured by the very government that later rides in to make emotional appeals for sweeping changes. It has happened before, and it is sure to happen again.

It is a positive sign that the hard work of activists on many fronts is finally coming to fruition and coalescing to such a degree that states are clarifying and solidifying their lines in the sand.

Are you cheering, feeling good, elated by this news?
Then I requst you read for what effect their passages will have on stopping Federal gun control or even outright confiscation.
Think it will be stopped by state laws or "FORCE OF AUTHORITY" by those states, then I suggest you read it a third time.
All that has been done is to relieve all your State Government Representatives, Judicial and policing personel, to not be held accountable or responsible when Feds come haul your guns and your live or dead ass away.
It absolves them from all blame of not upholding oaths to State Constitutions or Charters and foremost Oath of all, The Constitution of the United States.
Your police will not take part and go visit the donut shops and your elected will yell vile obscenities and return to playing stink finger with their colleagues or other consorts.
In the meantime the states will take all the money and equipment they can get from DHS and other military alphabet labeled orgs they can get.
In times past states at least could call upon their National Guard and state militia groups to fight against enemies "Foreign or Domestic" and all their police as well, but not any more.
First they made the NG the state militia, and then under Regan and successive Presidents they made the NG as part of active military.
A call to a few gun roups in each state showed they were elated and patting each others asses and when I asked about my concerns all they could say was that they were too busy now but would call back later.
I told them no thanks as I had notime to talk with men who put their undershorts on backwards.

This is great, they can't stop everyone. It's definitely a valid point that you can't even rely on the sheriff these days. Montana has done an excellent job with their version. Let's see how far the feds want to take this.

Anyone who would change, take away or alter any of our rights under the Constitution should be given the option of giving up their citizenship and leaving the U.S.A. or be hung in public !

We must stick together to defeat the gun banners and their ilk!!!

SMOKE AND MIRRORS IS WHAT THEY HIDE BEHIND.
Read the bills thouroughly and look behind the words and phrases. And note who not what is being protected.
This bills of crap in all three states does no more than protect the political futures of elected bureaucrats and members of their Judicial and police forces.
They will not bite the feds when they come to haul your guns and or your ass live or dead away.
All they say is that they who govern and their enforcement officers will not participate in enforcing gun laws by Federal Agencys.
It says it will retaliate against any officers of the state who participate or impede what they classify as legal weaponry or parts there of.
That means that when the feds arrive the local cops can head for the donut and coffee shops and after the fact if you are not hauled away they can stop by and say how sorry they are but their hands are tied from interfering.
Your elected will yell and screech and send out formal complaints in a show of vote gathering solidarity; And then return to state buisness at hand by playing stink finger with collegues and consorts.
One can wonder what an oath stands for if it has no one to stand for it.
FOR ALL OUR ELECTED AND THEIR STATE ENFORCERS SWORE AN OATH TO PROTECT SECONDLY THEIR STATE CONSTITUTION AND FIRSTLY TO PROTECT THE CONSTITUTION OF THE UNITED STATES FROM BOTH FOREIGN AND DOMESTIC ENEMYS.
To gun owners it by now should be appsrent there is no one but yourself to decide who and what you are to do inthe future.

It seems that the 2nd amendment is under attack, and as he also said....“The beauty of the Second Amendment is that it will not be needed until they try to take it.” -Thomas Jefferson

At Least MONTANA is taking a stand. Montana is & always will be for Freedom & Our Rights. Montana was the LAST STATE TO JOIN THE UNION. SO MONTANA HAS ALWAYS SAID. THEY WOULD CECEDE IF NECESSARY. I AM FROM MONTANA & I HAVE SEEN THE WAY HORSE THIEVES & RUSTLERS & BANK ROBBERS WERE TAKEN CARE OF. DON'T MESS WITH US BECAUSE WE WILL RETALIATE. WE WILL NOT GIVE UP OUR GUNS OR OUR FREEDOM. WE'LL FIGHT & DIE FOR IT IF NECESSARY. HOW ABOUT THE REST OF YOU. There's an old saying. PUT UP OR SHUT UP. AMEN.

What stand?
They talk but every policeing agency is tied into DHS policy and will under an emergency be under its command.
They bow and scrape for every penny or supplies as well that they can get from the fed.
Militia groups in Montana, organized or unorganized, have for years stated what was coming and even now when the obvious can be seen they are looked upon as a bunch of kooks.

Good comment about the smoke and mirrors HB.

Wonder why the author couldn't use the same analytical skills to see through this con?

In Montana, you can get life in prison for marijuana. Many 'horse thieves, rustlers and bank robbers' were poor people trying to take back the people's money. The Montana law did deal with them in a most severe way........protecting banks from little people.
Big bank fraud, big financial scandals, big polluters............MONTANA is a weak sissy state, too cowardly to stand up to corporate pigs.
Montana is not free, but at least one of their citizens (11:53) thinks they are......most likely due to heavy doses of government propaganda and too much TV. Sad really.

The South withdrew from the Union and formed a separate nation due to violations of the US Constitution that pale in comparison to those being so flagrantly violated today. Nevertheless, it is encouraging to see individual States and the American people waking up once more to the various forms of tyranny associated with all central governments, with the present government being no exception.governments.

Must be nice to live in a free state or at least a state that wants to be free. I'm stuck here in the People's Republic of Kalifornia for now, but I'm planning my escape to freedom.

Must be nice to be so totally absorbed in your gun fetish that you can ignore all other major Constitutional violations in these States.

Gun laws are NOT a litmus test for freedom.
But the gun industry shills want you to think it is the only thing that matters.

Hide Behind said...

No gun laws are not the litmus test for freedom but beings how the only portion of the Constitution left to Defend is not the fn guns but the ideals of the Second Amendment, I do not call that a fn fetish.
The removal of the 2nd Amendment is indeed the litmus test of any Freedom and concepts of Rights.
Not just here for americans but for all peoples.
Much BS about Corporate and finacials running this nation but who and blue blazes thought up globalization and pushed IT down the throats of peoples who believed in Constitution?
THE MAJORITY OF US POPULATION AND SOME LIBERAL MIDDLE CLASS BELIEF THAT WE WERE A FN DEMOCRACY AND HAD A LIVING BREATHING (sic) hence out of date: constitution.
This was done by smiling idiots of both gunwavers war loving and the crotch loving. Partys.
Now they both have what they wanted but are finding out they both now have to pay for it.
Many of early groups said it will only be possible to wake up nation when middle class gets kicked in crotch were right.
Hell the poor working class did not have the expendable cash to play in politics and were already broken and despondent from just trying to survive and their greatest enemy was not the banks but the fn middle classes self serving obediance to the system.
Fetishes hell the unrecognized to themselves fetishes and memes galore of the so called midfle class are innumerable.

The gun "industry" is correct and gun laws have proved repeatedly throughout history to be a litmus test for freedom.
The second amendment is the right that protects all our other rights.

“Among the many misdeeds of the British rule in India, history will look upon the Act depriving a whole nation of arms as the blackest.
- Mohandas K. Gandhi
“All political power comes from the barrel of a gun. The communist party must command all the guns, that way, no guns can ever be used to command the party.”
- Mao Tze Tung, Nov 6 1938
“The most foolish mistake we could possibly make would be to allow the subject races to possess arms"...Adolf Hitler, dinner talk on April 11, 1942
Guard with jealous attention the public liberty. Suspect everyone who approaches that jewel. Whenever you give up that force, you are ruined…The great object is that every man be armed. Everyone who is able might have a gun.”

US government does the following'

illegal spying on innocent Americans
illegal TSA abuses of innocent Americans for simply wanting to travel
illegal TSA abuses of innocent Americans at sporting events
illegal detention of Americans without trial
illegal torture of Americans without trial

GUNS stopped nothing, not one of those abuses.
But the gun salesmen in the $11 billion dollar per year gun industry want to be free to sell more guns. So they employ thousands of trolls and 'friendly' websites to lie and confuse people.
Like that alleged quote by Hitler and the one by Gandhi.........pure lies. Must be why the gun salesman didn't provide links. Never trust a gun salesman.
